SOUTH JERSEY PROGRESSIVE DEMOCRATS TO APPEAL CAMDEN JUDGE’S RULING

July 12, 2025

On Friday, July 11, 2025, in Camden Superior Court, Judge Michael Kassel ruled against the three representatives duly elected to serve on the Cherry Hill Democratic Committee, elected on the South Jersey Progressive Democrats (“SJPD”) slate. According to state statute, vacancies of municipal committee are to be filled by the elected committee members, which means that the undisputed winners, Susan Druckenbrōd, David Stahl, and Rena Margulis on the SJPD slate, are empowered to make those appointments. The Camden County Democratic Committee, Inc. (CCDC) seeks to restrict who the Defendants can select to fill those vacancies, to a list of the 74 candidates from the losing slate. The outcome of the court hearing in Camden was ultimately a 45 day stay during which neither SJPD nor the CCDC can attempt to fill those vacancies. The elected candidates plan to file an emergency appeal.

The Cherry Hill electeds presented undisputed evidence during the three-hour oral argument that over 62% of Cherry Hill voters voted for them, as did a whopping 90% of the voting districts across the municipality. If the Judge’s decision were to stand, it could effectively render 58% of Cherry Hill voting districts with no or under- representation, while allowing 25% of the districts to be over-represented.

“The CCDC’s assertion that the election was a tie is completely absurd. Our candidates won overwhelmingly. They are now the elected Cherry Hill Democratic Committee members and the state statute expressly states that they are legally empowered to fill the vacancies on the municipal committee. In the outreach we performed before the Norcross machine filed their lawsuit to try and reverse the election, we connected with nearly 100 interested Cherry Hill Democrats who would like to be considered for a spot on Cherry Hill Democratic Committee. The people who expressed interest in being considered are representative of the diversity of the Cherry Hill community. The legal actions of the CCDC post election not only seek to overturn an election result they don’t like but they also are once again illustrating that they want the party to be closed off, inaccessible to new people, a space open only to their loyalists. We all pay for the closed culture of Camden County politics in a loss of new voices, new talent, new perspectives. But Cherry Hill voters voted for change. We have the support of Attorney General Platkin and I believe public opinion in our county and state is on our side. I’m confident in the merits of our case and that we will find justice at the appellate division,” said South Jersey Progressive Democrats President Kate Delany.

“The Municipal Committee race in Cherry Hill is a winner take all race and has been for decades. The winner takes all. To the winner goes the committee. This spring, we ran. We talked to voters. We campaigned. And in June we won. We won because the voters elected us. We see no logic in today’s courtroom interpretation of the race and the results, we cannot see the validity of the losers, Camden County Democrats, now taking control of the committee. That move is antithetical to what democracy and elections mean. We have democracy because as Americans we agree that voters and votes matter. Do we believe in the sanctity of democracy and in respecting the will of the voters? I certainly do! We will appeal this decision and we will continue to advocate for a more perfect union,” said Defendant Susan Druckenbrōd, Treasurer of the Cherry Hill Democratic Committee.

“I look forward to appellate judges from outside of Camden County reaching a decision that reflects the will of Cherry Hill voters, who ousted the Norcross machine incumbents.  I look forward to a decision that considers the statutory interpretation of the New Jersey Attorney General, who has sided with us in this case,” said Defendant Rena Margulis, Vice-Chair and Secretary of the Cherry Hill Democratic Committee.

“Call me an idealist, but I believe in democracy and the potential of our country. Of late, there have been attacks on democratic ideals prevailing in the court systems. We mustn't take our democracy for granted, and when a SCOTUS justice states that the status of our democracy keeps her up at night, we really need to be extra vigilant in upholding the will of the electorate. 5500 voters–62%--chose the three of us as duly elected representatives. Ignoring that clear mandate and handing control of the committee to the election losers is counter to that system,’ said Defendant David Stahl, Chair of the Cherry Hill Democratic Committee.

“The Court’s decision was obviously disappointing to us, particularly because the law is clear that the three newly elected members of the Cherry Hill Committee are the ones identified in the statute as having the power to appoint individuals to fill the vacancies.  There is no provision anywhere in the law requiring the losers of an election to be appointed into a vacancy.  And the judge appeared to twist himself into knots to find that this race had a “tie” requiring 71 of the losers to be appointed, thereby giving the vast majority of the seats to the slate that was drubbed in the election.  This was obviously not a tie in any sense of what a tie means.  It was a landslide election victory for the SJPD candidates.  The will of the voters has to prevail.  We were prepared for this, and we fully expect a reversal on appeal,” said Joseph Bouvier, Esquire of South Jersey Progressive Democrats, elected member of the Merchantville Democratic Committee.

The Defendants are represented by Yael Bromberg, Esq. of Bromberg Law LLC, a constitutional rights litigator, legal scholar, and lecturer of election law at American University Washington College of Law. Bromberg said: “The will of the voters directs the mandate: they voted for change. That call for change did not happen in a vacuum; it happened in an ecosystem. Both the law and the constitution are on their side, and we are confident that an appeals court will find in our favor.”

Feb 26,2025

On Wednesday, February 26, a state judge tossed out charges against party boss George Norcross and those charged alongside him. Superior Court Judge Peter Warshaw granted Norcross' and other defendants' motion to dismiss a state grand jury's indictment on racketeering charges brought by Attorney General Matt Platkin. “Defendants correctly argue that when considering private parties negotiating economic deals in a free market system, threats are sometimes neither wrongful or unlawful. In these situations, there may be nothing inherently wrong in using economic fear to obtain property,” Warshaw wrote.

“Today’s news is certainly disappointing to everyone in New Jersey who is envisioning a more just and ethical future for our state. In South Jersey, George Norcross’s name remains shorthand for political corruption. Judge Warshaw’s comment does not speak to the undemocratic machinations so many of us have seen up close– the backroom deals, the cronyism, the Norcross machine’s penchant for running the public government like a private club, all to maximize their own self-dealing. Though the news is disappointing and we hoped for a different outcome, South Jersey Progressive Democrats have successfully organized for improved democracy for years, ousting the phantom candidates, advocating for a fair ballot, and educating voters about dark money in our elections and pay to play operations in our communities. The organizing work continues to get us the equitable, thriving South Jersey we deserve, ” said Kate Delany of South Jersey Progressive Democrats.

“Since 1989, George Norcross has been installing his friends and loyalists in positions of power throughout South Jersey. For decades, he abused the power of the now-named likely unconstitutional county line to control the actions of our elected officials. Now, the court laughably says that these threats are between private parties. Private parties do not have the luxury of leveraging the power of elected officials to benefit their own interests; these are not negotiations, these are extortions,” said David Stahl of South Jersey Progressive Democrats.

“It is disappointing that the Court threw out the indictment of George Norcross and the other members of the Norcross Enterprise.  The judge’s dismissal, at least for now, effectively nullifies the findings of the grand jury, which felt there was sufficient evidence for the charges to go to trial against all of the defendants.  We at South Jersey Progressive Democrats would have preferred to see a jury render a verdict after considering all the evidence in the case.  We hope Attorney General Platkin’s appeal is successful so a real trial can occur.  As we see too often nowadays, there is a separate system of justice for the wealthy and politically-connected, one that fails to hold powerful people to account.  But we will continue the fight against corruption, political threats, and cronyism, because we have to.  Our democracy depends on it.  All across the country, people are alarmed by the sight of our democracy sliding toward becoming a nation controlled by wealthy individuals who are in it for themselves.  Once it happens, it is hard to recapture our freedoms.  People in South Jersey, especially in Camden, see it too, but here it is corrupt George Norcross and his minions in the Democratic Party who control the levers of power and disregard the needs of most citizens.  We won’t give up, we will keep putting up anti-corruption candidates with integrity and honor, who care about public service rather than appeasing party bosses and personally benefiting financially from their official duties.  Join us if you can,” said Joe Bouvier of South Jersey Progressive Democrats.

“The grand jury did its due diligence and obviously felt the case warranted being brought to court and before a jury. In an age when we are witnessing our federal judicial system being weakened and attacked at every level, today’s decision by Judge (and jury) Warshaw is deeply troubling and reinforces commonly held beliefs that the wealthy and well-connected operate in a legal system much different and much more forgiving than the common citizen. My faith in New Jersey’s judiciary is shaken today,” said Susan Druckenbrod of South Jersey Progressive Democrats.

On Tuesday, November 12, the U.S. House of Representatives blocked a dangerous piece of legislation that would have granted the Secretary of the Treasury the unilateral power to investigate and effectively shut down any tax-exempt organization that they wanted to accuse of wrongdoing. This bill, HR 9495, would have allowed Trump to censor any organization without even giving a reason for revoking their tax exempt status. A coalition of over 130 civil liberties, religious, reproductive health, immigrant rights, human rights, racial justice, LGBTQ+, environmental, and educational organizations opposed this bill. Yet Congressman Donald Norcross (NJ1) voted with Republicans in support of this bill that would have emboldened Trump and given him ammunition to silence critical civil rights organizations and watchdog groups.

As we approach four more years of a Trump presidency, it is essential that Democrats support organizations who work on behalf of human rights and the preservation of our democracy. The Democrats who voted in favor of HR9495 have massively betrayed their constituents by voting to give Trump more power and to put nonprofits and civil liberties groups in harm’s way. These DINOS have not only betrayed their constituents, they have also demonstrated a lack of respect for the right to free speech.

“Donald Norcross’s vote in favor of legislation that would let Trump swiftly attack and silence any group whose work he does not approve of is, on one hand, shocking. This bill would have put the work of so many essential organizations at risk and would have had a chilling effect on freedom of speech in our nation. On the other hand, here we again see Donald Norcross for what he is, the little brother of George Norcross, a party boss known for his brutality towards anyone who opposes him. Donald Trump’s friendship with George Norcross is well known. With this vote, Donald Norcross certainly acted like a friend to Trump, too,” said Kate Delany of South Jersey Progressive Democrats.

“We're used to our politicians in Camden County talking out of both sides of their mouth. They will say they support progressive ideas like closing incinerators but then when it comes time to actually vote on things that can help people - or in this case harm people - they continually let us down. This is the reason our congressman ran 10k votes behind Andy Kim and Kamala Harris here. Even Camden County Commissioner Director Cappelli suggests that Norcross, a purported leader in the Congressional Progressive Caucus, is ‘done and not politically relevant’ after not fighting Trump's agenda, and for once I have to agree with him” said David Stahl of South Jersey Progressive Democrats.

South Jersey Progressive Democrats Condemn Senator Jim Beach's Opposition to the Freedom to Read Act

FOR IMMEDIATE RELEASE

On Monday, October 29, the NJ State Senate approved pivotal legislation that will protect libraries and librarians as well as students’ access to books. The “Freedom to Read Act" will forbid local school boards from excluding access to books because of “the origin, background, or views of the material, or because an individual finds it offensive.” This piece of legislation will prevent books on race and LGBTQ themes from being removed from libraries.

South Jersey Progressive Democrats support this legislation and are aghast that Camden County Democratic Chairman and State Senator Jim Beach (LD6) voted against it. Beach broke with his party to oppose this legislation that will make sure New Jerseyans are not victims of censorship. Jim Beach was the only NJ Democratic Senator to vote no on this bill. Not only is Jim Beach out of sync with his party, he is also out of sync with the general public. According to a recent Rutgers poll, 58% of New Jerseyans are concerned about the threat of censorship via book banning.

“Jim Beach’s vote here clearly shows us that he is out of step with his district and with his voters. It’s infuriating that we are represented by a ‘Democrat’ who now sides with book banners. We need Democrats who will protect education and the pursuit of knowledge. It’s infuriating that Jim Beach obviously doesn’t see the importance of protecting this basic right,”  said Susan Druckenbrod of South Jersey Progressive Democrats.

“Once again we see our local Democratic leaders abandoning the guiding principles of the Democratic party and refusing to protect our children's right to a well-rounded education and their librarians from targeted harassment campaigns from organized extremist hate groups,” said David Stahl of South Jersey Progressive Democrats.
